A fire risk assessment is a structured review of your premises that identifies what could start a fire, who would be at risk if one did, and what needs to change to keep people safe. It considers the building, the way it is used and everyone in it.

The outcome is a written report recording the hazards found, the action needed and a date for review. It is a working document, not a one-off exercise, and must be kept up to date whenever the premises, its use or its occupancy changes.

Who Needs One?

Employers, landlords and business owners must maintain a valid fire risk assessment under the Fire Safety Order. The requirement covers virtually all non-domestic premises in England and Wales, including:

  • Offices, shops and retail units
  • Restaurants, pubs, cafés and nightclubs
  • Hotels, B&Bs, guest houses and self-catering lets
  • Hospitals, care homes and surgeries
  • Schools, colleges, nurseries and sports centres
  • Factories, workshops and warehouses
  • Village halls, places of worship and community buildings
  • Communal areas of flats, HMOs and shared residential buildings
  • Marquees, tents and other temporary structures

The only premises generally outside the Order are individual private homes. If you rent out residential property, the shared parts of the building still fall to you as the responsible person — and since the Fire Safety Act 2021 that also covers the building's structure, external walls and flat entrance doors.

Legal Requirement: Under the Regulatory Reform (Fire Safety) Order 2005, all employers and business owners are legally required to maintain a current and valid fire risk assessment. Failure to comply can result in criminal prosecution, large fines and reputational damage.
